Article 1 – Purpose

These Terms and Conditions of Sale (T&Cs) set out the terms under which Confiance et Performance – Stéphane Cavin, a business specialising in mental performance coaching, provides its services to clients.

Any purchase or booking of a service constitutes the client’s unconditional acceptance of these T&Cs.

Article 2 – Services provided

The business provides mental performance coaching services through different formats:

• Individual coaching: Sessions charged on an hourly basis.

• Full programme: A programme consisting of several sessions (5 or 6 sessions).

The services are intended for:

• Athletes and sportspeople

• Entrepreneurs and professionals

• Artists

• Adolescents

• People preparing for an examination

• Adults seeking personal development

• Emergency responders

• Humanitarian workers

• Crisis managers

Coaching sessions may be provided either in person or remotely via videoconferencing.

Article 3 – Pricing and payment

3.1 – Pricing

Prices are stated in euros (€) and are exclusive of taxes (or specify whether VAT applies).

The price list is available upon request and may be amended at any time. The price applicable to a service is the price in effect at the time of booking.

3.2 – Payment terms

Payment may be made by bank transfer, cheque or any other payment method accepted by the business.

• Individual coaching: Payment must be made before the session.

• Full programme: Payment may be made in full before the programme begins or in several instalments, subject to prior agreement.

In the event of non-payment, the business reserves the right to suspend or cancel any service in progress.

Article 4 – Booking, cancellation and rescheduling

4.1 – Booking

A booking becomes effective once the client has accepted these T&Cs and payment has been made in accordance with the terms set out in Article 3.

4.2 – Cancellation or rescheduling

• By the client: Any cancellation or request to reschedule must be notified at least 48 hours in advance. After this deadline, the session remains payable.

• By the business: In the event that the business is unable to provide the session, an alternative date will be proposed or a refund will be issued if no alternative arrangement can be agreed.

Article 5 – Commitments and responsibilities

5.1 – Commitments of the business

The business undertakes to provide personalised, confidential and ethical coaching.

5.2 – Client’s responsibility

The client acknowledges that mental performance coaching is neither therapy nor medical care. The client remains responsible for their commitment to the process and for applying the techniques taught.

The business does not guarantee any specific outcome, as results depend on numerous personal factors.

Article 6 – Protection of personal data

The information collected is used solely for the proper provision of the services and remains strictly confidential.

In accordance with the General Data Protection Regulation (GDPR), the client may exercise their rights of access, rectification or deletion of their personal data by contacting contact@confianceetperformance.eu.

Article 7 – Disputes and applicable law

These T&Cs are governed by French law.

In the event of a dispute, the parties will first seek to reach an amicable resolution. Failing this, the competent courts shall be those of [jurisdiction].

Article 8 – Acceptance of the T&Cs

Any booking constitutes the client’s full and unconditional acceptance of these T&Cs.
